They should have protection since the project is a branch of the other company. Thus the other company owns all of the images and coding and has the right to distribute them as they wish. I would suggest sending them a letter informing them that all of the images and the name are under the copyright laws. Threaten to send in lawyers and give them a fall back date. I would seriously go after them legally if they don't stop however.
